1. Website Ownership
The sale of wine offered on our Carvinea website is governed by these General Terms and Conditions of Sale. All products purchased on carvinea.com are sold directly by Carvinea Azienda Agricola Vitivinicola Sarl (hereinafter referred to as "Carvinea"), with registered office in Italy, S.S. 100 km 18 Il Baricentro L16 M6 70010 Casamassima (BA), Reg. Imp. Bari (Bari Register of Companies), Tax Code and VAT No. 00949790729, Share Capital Euro 520,000.00 fully paid-up.

2. Preamble and Acceptance of the General Terms and Conditions of Sale
These general terms and conditions of contract (hereinafter also "General Terms") govern the offer of products by Carvinea on www.carvinea.com (hereinafter also "Website"). The General Terms must be accepted by the User upon registering on the Website in order to use the service offered.
Carvinea reserves the right to modify these conditions in whole or in part at any time by giving notice to the User through publication on the Website.
Users who continue to use Carvinea following the publication of changes accept the new conditions without reservation.
3. Website Registration
The Website is intended exclusively for Users who are at least 18 years of age. Browsing and using the services offered on the Website are accessible upon registration. Registration is free of charge.
The User must register by providing, truthfully and completely, all data requested in the relative registration form and fully accept the privacy policy and these general conditions. The User undertakes not to transfer their credentials, even temporarily, to third parties, and to keep them with due care, diligence, and secrecy under their own responsibility, as they constitute the sole means to identify the User and validate access to the offers. The User is therefore informed that all actions taken using said credentials will be attributed to them and will have binding effect against them. It is understood that in no case shall Carvinea be held liable in the event of loss, disclosure, theft, or unauthorized use by third parties, under any title, of User access credentials.
Registration is required to purchase products and to access summary information regarding activities performed by the User on the site (also "Account").
Partial registration to the Website is also permitted (hereinafter also "Partial Registration"), through the entry of the user's email address alone to receive newsletters.
If a User who has performed Partial Registration wishes to proceed with purchasing products on the Website, it will be necessary, prior to the checkout phase, to complete the mandatory fields required to complete the purchase.
At any time, the User may update and/or modify or request the deletion of the information provided during Registration. However, in the event of a deletion request, Carvinea may temporarily retain, in whole or in part, such information solely for the purpose of completing any purchases made and/or concluding accounting and tax procedures.
Carvinea reserves the right to suspend or delete the User's account at any time and without notice if it considers that:
– the User has violated the Agreement
– access to or use of the Service could cause harm to Carvinea, other Users, or third parties
– the use of Carvinea by the User may result in a violation of applicable laws or regulations
– in the case of investigations conducted as a result of legal actions or involving public authorities
– the account is deemed by Carvinea, in its sole discretion and for any reason, to be inappropriate, offensive, in violation of the Agreement, or not aligned with Carvinea's standards.
4. Product Identification
The product offering relates to the categories of alcoholic food products (wine products), extra virgin olive oil, and other accessory products for their consumption. The Products offered for sale on the Website are exclusively those advertised in the dedicated section. Product images are for illustrative purposes only and do not constitute a contractual element.
The catalog may include product availability subject to quantitative and/or time limits.
5. Terms of the Offer
Before completing a purchase, the User must review the characteristics of the goods illustrated in the product datasheet for the item they intend to buy, respecting any purchase limits indicated therein.
Prices (expressed in Euros and inclusive of VAT), descriptions, or product availability may be subject to change without notice, taking effect from the date of publication of said changes on the Website. Carvinea will do its best to present product characteristics in as much detail as possible within each datasheet corresponding to the product viewed by the User. However, images and colors of products offered for sale may differ from the actual ones due to various factors including, but not limited to, the User's display screen, photographic filters, etc. Therefore, the User acknowledges and accepts that such minor differences do not constitute a lack of conformity of the products.
Shipping costs are a fixed amount and may be free if the total order amount exceeds a specified value or pursuant to a specific promotion. In any case, the User is always informed of the shipping costs prior to completing the purchase process and making payment.
The validity of offers may be subject to quantitative or time limitations, after which they may no longer be available. The validity date and/or available quantity of offers are reported on the Website to allow the User to be aware of them. Carvinea may modify the duration of an offer at any time and at its discretion, provided that it will fulfill orders placed during the term of a specific offer.
In some cases, a product's availability may end after a purchase has been placed: in such cases, where applicable, Carvinea will refund the User.
Products on the Website are intended for sale for personal use. Consequently, the User warrants that they are acting as a final consumer and do not intend to resell, directly or indirectly, products purchased on the Website and/or by telephone for commercial purposes.
Carvinea reserves the right to cancel orders received if the user, in order to circumvent purchase limits indicated in the conditions of sale:
- uses a fictitious email address with a shipping address identical to another registered user.
- enters a billing address identical to another address already used by another registered user.
In any event, Carvinea reserves the right to temporarily suspend the sale of certain wines should it detect order anomalies, such as a high volume of purchases for specific wines in specific areas.
6. Coupons
Carvinea may issue discount codes (hereinafter also "Coupons") that the User can use when purchasing products. Coupons are issued as alphanumeric codes, and their function is determined indisputably and at the sole discretion of Carvinea. The User may enter the Coupon into the dedicated "Coupon" field during order placement. Coupons are generally usable by the user for a limited period of time, after which they will no longer be valid. A Coupon may be subject to a minimum spend requirement, below which its use will not be possible. Unless otherwise specified, Coupons are personal, tied to the User's Account, and valid for a single purchase, after which they will automatically be invalidated. Coupons cannot be combined. Coupons cannot be sold, assigned, and/or transferred to third parties without explicit authorization from Carvinea. Carvinea reserves the right to cancel any previously issued Coupon, even prior to expiration, without obligation to justify the reason and without entitlement to indemnity or compensation. Carvinea reserves the right to revoke Coupons issued to users who misuse them, without prior notice and without entitlement to indemnity or compensation.
7. Purchase Procedure and Payment Methods
Each order submitted constitutes an offer to purchase the products covered by the order.
Order fulfillment is subject to product availability and discretionary acceptance by Carvinea. In any case, the company reserves the right to cancel orders and refund the amounts paid.
The User must select the products and complete checkout after carefully reviewing the information in the order summary. The order is placed upon confirmation and is subject to payment of the price, taxes, and shipping/payment fees indicated. Upon successful payment, the User will receive an order confirmation email containing information regarding the purchased offer. The order confirmation will contain a summary of the delivery and billing addresses. In the absence of the confirmation email, the purchase cannot be considered validly concluded.
Accepted payment methods are those listed in the shopping cart and on the checkout page. Unless otherwise specified in the offer terms, due amounts are charged upon payment confirmation. In any case, Carvinea uses third-party tools to process payments and does not come into contact with payment details, such as credit card information provided.
If an order is not confirmed for any reason, Carvinea will issue a full refund of the amount paid by the user.
8. Shipping, Delivery, and After-Sales Support
Carvinea undertakes to deliver goods within 7 working days from the order date; average delivery times are 24/48 working hours throughout Italy, with the exception of islands and remote areas where average delivery times are 72/96 working hours. A specific delivery date or time cannot be guaranteed as this depends on the courier, destination address, and delivery personnel. Carvinea shall therefore not be held liable for any direct or indirect consequences resulting from these timeframes.
Carvinea cannot be held liable for delivery errors due to inaccuracies or incompleteness in the purchase order completed by the User, for damage to products occurring after delivery to the carrier, or for delivery delays attributable to the carrier.
Carvinea uses packaging designed to guarantee product integrity. In any case, upon delivery of the goods, the User must check that the packaging is intact, undamaged, unaltered—including sealing materials (adhesive tape or strapping)—and shows no leakage. Any damage to packaging and/or products must be immediately disputed by the User by writing a specific written reservation (specifying the reason, e.g., "Punctured packaging", "Crushed packaging", etc.) on the courier's delivery document. Once this document is signed, the User may no longer raise objections regarding the condition of delivered goods. Any issues regarding physical integrity, correspondence, or completeness of received products must be reported within 3 days of delivery by emailing: info@carvinea.com.
In the communication, the User must provide a description of the defect, product code, sequential order number issued at purchase, and identifying details of the invoice issued by the seller for the purchased products.
In the event of non-delivery within specified timeframes, the User must notify Carvinea, which will verify shipment status and any anomaly with the courier. Following a shipment anomaly (e.g., lost or destroyed package during transit), Carvinea will resend the product, subject to warehouse availability, or issue a full refund for the order.
9. Product Warranty and Conformity
The User is also aware that images used in offers may sometimes be indicative only and may not always faithfully represent the delivered product. Carvinea is directly responsible for product conformity. In the event of non-conforming products, the User shall contact Carvinea by emailing info@carvinea.com.
Carvinea will collect the bottle(s) to initiate verification procedures. For verification purposes, at least 70% of the wine must remain in the bottle(s) and the original cork/cap must be securely inserted in the neck. If the defect is confirmed, replacement or refund will follow.
10. Right of Withdrawal
When purchasing products on Carvinea, the buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of receiving the products, returning the delivered item intact and without alteration to Carvinea. The right of withdrawal does not apply to sealed products that have been opened by the Customer.
Notice of withdrawal must be sent by email to info@carvinea.com within 14 days of delivery and must contain:
- declaration by the user to exercise the right of withdrawal pursuant to and for the purposes of Art. 54 of Legislative Decree No. 21/2014;
- indication of products for which the customer intends to exercise withdrawal, including product item codes;
- sequential order number issued at purchase;
- identifying details of the invoice issued by the seller for the purchased products.
A buyer who exercises the right of withdrawal must return the goods intact and unaltered within 14 days from the date of communicating withdrawal. Return shipping costs are borne by the user. Goods must be shipped to Carvinea Azienda Agricola Vitivinicola S.S 100 km 18 Il Baricentro L16 M6 – 70010 Casamassima (BA), Italy. The user is responsible for packaging returned goods and undertakes to take necessary precautions to safeguard product integrity and protect items from damage and/or alteration.
Goods must be returned intact in their original packaging, complete in all parts, accompanied by annexed tax documentation. Subject to verification of the above, Carvinea will credit the amount paid for the purchase of the product(s) to the withdrawing party within a maximum of thirty days from the date the seller learned of the exercise of withdrawal. In any case, reimbursement will not occur before:
- Carvinea receives the product shipment;
- Carvinea verifies product integrity.
Clauses concerning exercise of the right of withdrawal, including consequences and exceptions, apply exclusively to Users qualifying as consumers—that is, Users acting for purposes unrelated to their business or professional activity.
11. Liability of Carvinea
Carvinea shall not be liable for damages resulting from the use of the Website, such as computer viruses, omissions, service interruptions, and software failures—including damage to User equipment—that prevent or delay service provision due to external causes, force majeure, and/or third-party actions beyond the owner's control.
Under no circumstances shall Carvinea be held liable for delays, defects, or non-conformities resulting from events beyond its reasonable control, including but not limited to:
- events of force majeure;
- third-party actions, such as interruptions or malfunctions of telecommunication operator services and/or power lines, or acts or omissions by carriers or forwarders.
12. Intellectual and Industrial Property
Carvinea Sarl holds all rights relating to the graphic and conceptual content of the Website, its distinctive marks rendered visible therein, as well as every name, symbol, and image used to designate Products on the site. Reproduction, even partial, of the Website's content and graphics, as well as distinctive marks displayed on it, is strictly prohibited.
13. Applicable Law and Jurisdiction
These General Terms shall be governed in every respect by Italian law. For any dispute concerning interpretation, execution, and/or termination of the contract between the User and Carvinea, the Parties recognize that the Court of Bari shall have jurisdiction.
